General Terms and Conditions (GTC)

1. Scope

1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to the use of the website www.lovefeet.ch (hereinafter referred to as “Website” or “Online Store”) as well as to orders placed through the Online Store in their current version at the time of the order. The Website is owned and operated by masigra AG. Contracts for online orders are concluded between the customer (hereinafter referred to as “Customer/s”) and the supplier, masigra AG | LoveFeet (hereinafter referred to as “LoveFeet”).
1.2 LoveFeet reserves the right to change these GTC at any time. The version of the GTC in force at the time of the order is decisive and cannot be unilaterally changed for the order. Opposing or differing terms and conditions of the Customer will not be recognized.
1.3 Divergent, additional, or contradictory terms and conditions of the Customer will only be recognized if LoveFeet has expressly approved their validity in writing.
1.4 The offer of products and services is valid as long as they are available and/or can be ordered in the Online Store and is exclusively directed at customers in the offered delivery countries.

2. Terms of Use

2.1 LoveFeet is not obliged to accept a customer’s registration or orders. LoveFeet is not obliged to permanently provide the Website / Online Store and its services. Already confirmed orders are not affected by this.
2.2 If the customer provides incomplete or incorrect information during registration or fails to notify LoveFeet of any changes, LoveFeet is entitled to exclude the customer from using the online store with immediate effect.
2.3 LoveFeet will treat personal registration information confidentially and prevent access by unauthorized third parties.

3. Subject of the Contract, Product Features

3.1 The products and prices in the Online Store are considered an offer. This offer is always subject to the condition precedent of a delivery impossibility or an incorrect price indication.
3.2 All information in the Online Store (product specifications, descriptions, images, videos, dimensions, weights, accessory references, and other details) are subject to error and do not represent a guarantee of properties.

4. Conclusion of the Contract

4.1 The purchase contract for products or services with LoveFeet is concluded as soon as the customer places an order in the Online Store (hereinafter referred to as “purchase contract”). The receipt of an online order is indicated to the customer by an automatically generated order confirmation from LoveFeet to the email address provided by the customer. The order confirmation does not contain a promise that the product can actually be delivered. It indicates to the customer that the order has been received in the Online Store and that the contract with LoveFeet has been concluded under the condition of delivery possibility and correct price indication.
4.2 The customer must be at least 18 years old and fully legally competent.

5. Prices

5.1 The price at the time of the order in the Online Store is decisive for the conclusion of the purchase contract and represents the final prices, which include all taxes (in particular VAT), any advance recycling fees (vRG), and other possible costs.
5.2 In addition to the final price, delivery costs are charged, unless otherwise offered, if the shopping cart total is less than CHF 50.00. LoveFeet reserves the right to change the prices of the offered products and additional services at any time. Additional services are listed separately in the shopping cart and on the invoice.

6. Payment

6.1 The customer has the payment options offered in the Online Store under “Payment Options” available.
6.2 For payment by credit card or other immediate payment methods, the charge is made at the time of the order.

7. Delivery and Retention of Title

7.1 Orders oblige the customer to accept the products and services. Subsequent changes or cancellations of orders by the customer may be accepted at the discretion of LoveFeet. If after an order or conclusion of the contract a partial or complete delivery impossibility occurs, the customer will be informed by email. If the customer has already paid, the amount will be refunded.
7.2 LoveFeet places great importance on indicating availabilities and delivery times in the Online Store up-to-date and accurately. However, due to production, delivery, or logistics bottlenecks, delivery delays may occur. All information on availability and delivery times is therefore without guarantee and may change at any time.
7.3 The products remain the property of LoveFeet until full payment of all claims arising from a purchase. The customer authorizes LoveFeet to make a corresponding entry at the customer’s expense in the retention of title register, if necessary. Before the transfer of ownership, pledging, transfer by way of security, processing, or alteration without the express consent of LoveFeet is not permitted.

8. Use of Promotional Vouchers

8.1 Vouchers can only be used in the LoveFeet Online Store at www.LoveFeet.com. Vouchers are only valid for the period specified and can only be redeemed once – before completing the ordering process. Vouchers cannot be combined with other vouchers, coupons, or possible discounts. Some products may be excluded from the voucher action.
8.2 Only one voucher can be used in full per purchase (no partial use of vouchers is possible). The required minimum order value may not be less than the value of the voucher. If the required minimum order value is no longer reached due to a return, we reserve the right to cancel the voucher.
8.3 If the value of the voucher is not sufficient for the order, the difference can be settled with the payment methods offered.
8.4 If the customer exercises their right of return, the reduced purchase price will be refunded. There is no right to a refund or replacement of a voucher.
8.5 Vouchers cannot be paid out in cash or returned, and no credit interest is paid. Remaining balances on vouchers will not be refunded.

9. Returns

9.1 LoveFeet grants the customer the right to return ordered products within 14 calendar days of shipment of the goods. The return is at the customer’s expense and must be made with the return form. The customer must return the returns to the respective delivery service free of charge and independently. Products ordered in the Online Store cannot be returned to a LoveFeet store.
The right of return is subject to the condition that the goods are intact, show no signs of use, and are returned complete (including all accessories and other packaging elements). Damaged products will not be accepted or will be charged to the customer in full.
9.2 Returns that LoveFeet cannot assign to a customer order will be stored by LoveFeet for 30 days and then disposed of.

10. Transport Damage

10.1 The customer must immediately check the delivered products for accuracy, completeness, and possible delivery damage.
10.2 Incorrect and/or incomplete deliveries or non-visible transport damage must be reported to LoveFeet customer service within 5 calendar days of delivery. The customer must keep the products as received in the original packaging and follow the instructions of customer service.
10.3 The delivery risk is transferred to the customer upon handover of the goods to the parcel or logistics service. To preserve the rights with the parcel or logistics service and/or insurance, the customer must check the integrity and completeness of the products upon receipt of the parcel.
10.4 In case of externally visible transport damage or quantity differences, the customer must make a precise and detailed reservation with the parcel or logistics service. LoveFeet is not responsible for this.

11. Warranty Rights and Guarantee

11.1 After delivery, LoveFeet guarantees freedom from defects and the functionality of the ordered product according to the product description details in the Online Store. LoveFeet may fulfill the warranty at its discretion with
– free repair (the original warranty period continues to run for the entire product)
– partial or complete replacement with an equivalent product
– credit (maximum the sales price at the time of the order)
11.2 Damage caused by wear and tear, improper use, or damage caused by the customer or third parties, as well as defects due to external circumstances (e.g., damage caused by natural events, damage due to moisture, shocks, blows, improper handling, customer or third-party interventions, etc.) are excluded from the warranty.

12. Liability and Disclaimer

12.1 LoveFeet is only liable for damages caused by intentional or grossly negligent behavior on the part of LoveFeet or its auxiliaries. This limitation of liability does not apply to damages resulting from injury to life, body, or health.
12.2 LoveFeet is not liable for indirect and consequential damages, as well as for loss of profit.

13. Intellectual Property Rights

13.1 LoveFeet owns all rights to trademarks, names, logos, images, texts, designs, etc. used for the website and the offer of products and services. These rights may not be used without the explicit authorization of LoveFeet.
13.2 LoveFeet websites may contain references to third-party rights (trademarks, designs, patents, etc.) that must also be respected.

14. Community Activities

14.1 Participation in community activities organized by LoveFeet is voluntary. The terms of participation and privacy policies are set out in the respective terms of participation.

15. Confidentiality and Data Protection

15.1 The collection and processing of customers’ personal data by LoveFeet is governed by the privacy policy. This privacy policy forms an integral part of these GTC.

16. Final Provisions

16.1 Swiss law exclusively applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The competent court is at the seat of LoveFeet, unless mandatory competent courts are provided by law.
16.2 If individual provisions of these GTC are or become ineffective, this does not affect the validity of the remaining provisions. The relevant legal provisions apply instead of the ineffective provision.
